The National Security Counselors claim DOGE qualifies as a federal advisory committee under the Federal Advisory Committee Act (FACA) of 1972. According to the lawsuit, the committee must maintain “fairly balanced” membership, record meeting minutes, hold public sessions, and file a charter—requirements DOGE has allegedly not fulfilled.
Lawsuit Aims to Halt DOGE Operations
Filed by attorneys Jerald Lentini and Joshua Erlich, the suit argues that DOGE has been “inappropriately influenced” by President Trump and other leaders. It seeks to bar DOGE from conducting official business until it complies with FACA standards.
The complaint also challenges the legitimacy of DOGE’s recommendations, citing concerns that private advisors embedded in federal operations create conflicts of interest. Kel McClanahan, Executive Director of National Security Counselors, emphasized the risk:
“Our only concern is that DOGE, as it is currently constituted, lacks the expertise to understand how its recommendations will backfire if it pushes federal workers out without understanding why they are there in the first place.”
